    The alleged crime for Curley and Shultz is perjury. They committed perjury during grand jury testimony which I'm guessing is within the last 2 years. So is the SOL on the actual crime they lied about or the time of the actual lie?

    Right, however, I find it impossible for them to be convicted of lying about something that occurred in 2002 when it really happened in 2001.. In perjury cases, you have to have every little fact.

    I find it impossible for them to be convicted of lying when none of the 4 people that testified had the same story and there is no real hard evidence backing any of their claims. Clemens has a steroid and DNA soaked syringe and he is going to walk...

  • The AG's offices is really F-ing this prosecution up. This latest mistake is unbelievable.

    I've heard it so many times, figured I had a good time to say it for once. I could have done a better job with this case than these people and I haven't touched a crim law book since 1L.

    I didn't even realize? I think it's usually one person does by accident and then everyone who quotes them automatically has it VIP without even knowing. I'm sure it's typically an accident in threads like this one.

    If what you are saying is that it's possible to have a "typo" to explain being off by a year, I will give you that - sorta.

    Remember, Corbett had been working on this for several years but opted to wait until after he was elected governor and to have his appointed replacement bring the charges. The numbers of legal eyes that were on this before the filing of the actual charges plus the volumes of research by the the Patriot-News makes it mind-numbing to think about the magnitude of this screw-up.

    Once that story was published (not the one where Sandusky was charged, but the one earlier in the year), someone in the AG's office someone in that office should have read it and said "Hold it!" "The dates are all wrong in this story!!"

    The most upsetting thing about this is that IF the case dies as a result, it may be that MANY lives have been ruined without cause. (Not alluding to the kids, BTW.) And now, the additional screw-up linked in warner3398's post. OMG!!

    My possibility was this - the backbone of the specific incident was McQueary's story (since they hadn't identified a victim). Maybe he told the AG 2002 by accident and meant 2001. Then maybe everyone else when prompted by questioning was asked "what happened in 2002" and nobody ever thought about it being 2002 or 2001, so the 2002 mistake slipped through the cracks. Who knows.

    The Febraury 9th vs. the Friday before spring break in March is the much more confusing part to me. That makes MM's testimony just wildly inconsistent.

    Either way, we're on the same page with this being completely botched at the AG's office in many ways.

    Ah. Not too bright. I was talking about the AG et al and wasn't thinking about MM.

    I already know that his testimony is flawed (from several first-hand sources) and wasn't even thinking that way.

    I believe you - just a big time gripe of mine.

    Posting what some kid said on twitter or a link to OnwardState or Pennlive really isn't super secret 24/7 info.

    Hearing from a co-worker that coaches youth sport XYZ with PSU coach ABC that some player is going to be missing time due to grades or an injury IS. But it's not my site so I have no say in the matter.

I see how the year slips through initially, but by the time you get to the point you are ready to press charges you should have some evidence to support the date you are putting into the charges.

    Complete and total lack of attention to detail. If an associate in my firm did something like this they would be fired immediately.
