SIAP but McQueary is suing Penn State? What exactly is a whistle-blower case? The article is not very clear but it doesn't sound good for anyone involved.

I think a lot of people figured this would be coming. He has a solid case as well, without looking at the specifics of his severance and such. We'll have to see. BOB coming on board matters too, depends if he got an interview with BOB.

A whistle-blower case is when plaintiff claims he/she has been retaliated against for disclosing information.

He was put on leave - wasn't fired. He is still commanding a paycheck, right? What has PSU done to retaliate on him for disclosing info?

He wasn't fired by the University for his testimony. He was placed on administrative leave which I assume means he was paid his salary. He would not have been retained by BOB. He has no damages to claim. IMO, he has nothing to gain but to bring more negative attention to the school.

There are a lot of other facts that need to come out... My internship was w the City of Phila over the summer doing labor and employment... This very stuff. But I have to say that a lot of my assignments were with the Fed statute... Some state, but this is interesting for me lol Could go either way. Will be interesting to see what facts go in PSU's favor... Did he follow up, is there another statute or employment contract terms that stipulate that he violated his contract... Interesting stuff indeed for us legal nerds.

Absolutely. Also matters how his termination was conducted and by whom and the timing.

Yep. I can't wait to see this play out... Personally, I just hope he loses... Lost a lot of respect for him over the last few months... Not for suing, but how he handled everything from jump... No one really knows what they'd do in those circumstances, but still. Lost a little respect for him...

Good for MM. I hope a jury gives him whatever he's asking for. He's got an excellent case IMO. It wasn't his fault he walked in on what he saw, but he did the right thing and reported it. The people he told decided to cover it up, and then he was place on administrative leave and eventually lost his job. They allowed his reputation to be trashed in the media and now he'll likely never coach higher than the high school level. He didn't do anything to deserve that. Penn State owes him bigtime IMO.

Yes, PSU owes him some, but I disagree quite a bit with this. I will keep it at that.
