    I really don't think that is the case. If you read the lawsuit, it is being made on the premise that the NCAA does not have anything in it's "Manual" that covers sanctions due to criminal acts. The NCAA should be fine with average cases of academic and athletic cheating.

    That's not the case that the suit is makeing, but it is supporting fact in the complaint.

    The lawsuit is seeking permanenent injunctive relief of the sanctions due to the injury said sanctions have and will continue to harm the Commonwealth. And it states 3 market areas that have and will continue to be harmed. The basis for the lawsuit is that the NCAA, Emmert, its Board of Directors and its Membership have caused injury to the Commonwealth by illegally violating certain Anti-trust sections of the Clayton Act and Sherman Act.

    Because this complaint seeks injunctive relief based on illegal activities of a Trade organization, whilst it may take time to go to trial, I can see a pre-trial motion from the Plaintiff requesting temporary injunctive relief from the sanctions while the Court hears the case.

    What was interesting to me, was this section, which explains Corbett's back-pedaling and filing the lawsuit:

    “For more than five months the governor supported the NCAA sanctions,” Neuman said in a press release. “As attorney general he waited years to take Jerry Sandusky off the streets and now as governor and a Penn State trustee he’s wasted months before standing up for this world-class university.”

    Corbett addressed these concerns in an interview with Don Lemon of CNN.

    “I originally supported the sanctions because I thought to myself, ‘If you belong to an association, you have to play by the rules of the association,’” Corbett said.

    However, the closer the commonwealth looked at the case, it realized that the NCAA did not have the authority through the process that they went through, he said.

    “I think that the NCAA who set the rules, have to play by their own rules,” Corbett said.

    A lot of people do feel that way, tbh. I try not to go with a "this guy" approach, because things vary so much. I know plenty of people in collegiate athletic administration that said the NCAA went to far, however it shoul dbe ok in this case because of the content. That's stupid to me but whatever, that's people.

    Personally if I am handling this for the NCAA, I stall it out until after the election. If Corbett has no chance but to win before or lose the election, well that isn't a good spot. They could easily settle at any time even if they are in court. I stall, try to get dismissal and saddle up for the haul, if he doesn't get elected, give him something cheap to sign and say "your last chance to put your stamp on it and not the next Governor". He'll fold. If he doesn't, give the next person the same, and/or evaluate the case and where you stand and go from there. Corbett will want his name on it though, that's how Governor's and legisllators roll in Lame Duck. Makes it so much easier for a few weeks.

    Is that what I want to happen? Hell no. But it'd be a helluva play. And one the NCAA should consider.

    I may be reading too much into this but if the judge grants the injunction, then the game will change? Not sure if that was a question or statement.

    1. BoT reviews Freeh Report and determines it is incomplete
    2. BoT has an independent legal review done on Erickson's ability to sign and rescinds consent decree

    One thing I actually see as a BIG problem and I agree with is the time frame. Unless the NCAA blinks quick, then they will drag this out until it doesnt matter. Those bastards are still in control.

    Any lawyers out there can answer this: Is it possible for the courts to impose some sort of injunction lifting the sanctions until a hearing is actually heard in the courts, and a formal ruling is given ?????

    I'm no lawyer but a number of others with knowledge of the law have said an injunction is very possible. If the commonwealth is serious about this battle I expect them to file for an injunction as quickly as possible.

    I believe the defense can request speeding up the process given the fact that the sanctions are already in place...or an injunction is granted, thus pausing the penalties until after ruling.

    Would this be a good idea? If it drags out for years and the NCAA wins, it is possible we have the same problem then instead of now with the possibility BOB is no longer the coach.

  • Is this really Corbett's doing? Gotta think this is a combo of the GOP trying to repair it's image in a key swing state and the state government trying to represent the majority interest of the state. Corbett and his puppets were the ones who consented to the sanctions, why would they wait til now? The election will proceed a verdict and a settlement while good, probably not good enough.

    That's a risk worth taking IMO. If it goes trough the court system it will likely take years so if you plan on fighting an injunction is a must. If not it will just drag out and the program will end up serving all of the sanctions.

    From what I've read, an injunction would only be granted if the State's case has significant merit. Basically, a judge wont grant an injunction if they believe there is no way the State can win, but if they think their facts make sense and it is a legit argument they will grant one. So if an injunction is requested and granted its probably very good news for PSU and there would likely be a settlement not too far down the road.

  • I know squat about PA politics, but is this enough of an issue that if in 2 yrs? when he is up for re-election and this is still ongoing, could become a campaign issue that might help him, i.e. the challenger wants to end this court battle but Corbett is here to fight for PSU....I honestly don't know if it would be enough to help but from what is said on here it seems as though he is pretty much dead in the water unless he can find an issue that will bring him a lot more support than he has lost....

    Just a thought, but this is so divergent from his previous statements that it is clearly a political ploy. I can't see the NCAA giving in if they think they can just drag it out until he is gone and he can't afford to settle for less than a win as in two years the surge he gets in the next week or two will be long gone. Would stand to reason then that he should expect it to be ongoing when the election rolls around in two years and must see some benefit in doing this.

    The NCAA is banking on public outrage again & ESPN will be more than happy to beat that drum again. Fortunately a court of law is not subject to emotional outrage.
