    Wow. I hope this is true. This is the kind of pressure that needs to be exerted. I don't think PSU can do much, but an outside body like the Governor's office could potentially change the game. Could at the very least get the NCAA to reduce the sanctions.

    I'd agree with that. Though I am still very up in the air whether I would want them to get involved with it beyond where the money goes. That said, the resources and influences a Governor's and Attorney General's Office(s) has is obviously immense and a huge asset.

    It should be interesting. I'm assuming that PA will file the suit in a federal court in PA which I would hope would be more sympathetic to PSU's interests. Regardless though this is going to take awhile to work itself through the legal system if it comes to that. I'm really interested in seeing what the states legal argument is going be.

    Absolutely. Unfortunately we have Lame Duck Session starting tomorrow so I may not be able to read the brief. Next few months should be hell. Anyways, the interesting bit would be timing with this whole thing. How long will it take to get back through the system, what exactly are they challenging, etc. etc...

    I think putting all the sanctions on the table is a negotiating tactic. Put it all out there and negotiate down to the money which is what the legislators really want.

    I don't think that would ever be granted, imo. If they even legally can, I'd be lying if I said I knew for sure either way.

    That begs the question do we want an injunction? If we get one and the sanctions get reduced or eliminated great. If we get an injunction then the negotiating gets down to the money not the scholarships then we are just extending the schollie pain.

    Schollies don't happen for a whole another year, so not sure how that would work at all.

    It would be a nightmare to figure out whether to recruit for 65 or 85. Would be willing to bet the school self imposes the same sanctions regardless.

    In that situation I would recruit for 85 and then dare the NCAA to force me to take kids scholarships away. But that's just what I would do.

    Thank god somebody has the fortitude to challenge Emmert. I've been on the "fight the sanctions" team from day one and utterly disappointed time and again to see Mr. Apologetic and the majority of the BoT curl into fetal positions in the corner. Some serious irony that the fight is coming from the governor's office of all places. He's a scumbag but this could still be a major positive relative to our current situation. This should be a textbook example of the sliminess of politicians - Corbett helps with the slaughter of PSU to protect his own hide and then when that backfires on him he does a complete 180 and files suit against the NCAA for slaughtering PSU.

    Vaguely remember a mention of a PA Dept of Education inquiry concerning Erickson's authority to sign the decree. Anyone else remember that?

    Attendance this year was down, correct. I think it would be very easy to check on tax receipts in State College or even the county.

    That's what I'm interested in seeing. Given that PSU is a public institution, they may argue that the NCAA doesn't have the ability to fine PSU. Also, the economic effect on PA along with the way the NCAA disregarded their normal procedures to impose the sanctions. They may also be able to argue that PSU was forced to agree to the sanctions or receive the death penalty which may not be legal. I think PA will have plenty of arguments. I'm interested to see if the courts say that the state has standing and if the consent decree voids any chance the state may have.
