SIAP: Erickson forced into decision by NCAA

  • If you guys are watching ESPN, Erickson spoke to ESPN saying that if PSU did not comply with the demands that were asked, they would be forced to serve a 4 year "death penalty".

    Thoughts?

    Just take the NCAA to court and sue them for everything they have. I wish... this is just so unjust.

    If that is the case seems like a good reason to sue. You can not be forced into,an agreement,

  • Technically you cannot be coerced into signing a contract you do not want to sign. Theoretically this could be a way to get out of the agreement if they wanted to challenge it in court but I don't see that happening.

    I know a better way to get out of the agreement -- discredit the Freeh report which Emmert relied upon to make his decision, and thereby expose Emmert for the ass he is.

    You kidding me or what? You should've told him to bring it, and then turned around and told him to kiss your old white ass that he'd be seeing in court.
    Maybe it's me, but that's what I expect someone with an ounce of testicular fortitude to do.
    As far as legality is concerned, can Erickson claim duress and therefore a voided contract, with an injunction on the NCAA sanctions? I'd imagine he is now getting tons of heat from bigtime donors about this and is wishing for a way to take some legal action.
    PS- Did anyone hear on Mike&Mike early this morning that we hired Gene Marsh? The one who represented Tressel before the NCAA last year?

    Wow, you cannot be pressured into any kind of agreement.

    Whether PSU agreed to not appeal or not, this pressure tactic has gotten many criminal cases tossed because the confession was improper and illegal.

  • I don't believe him. He and a few members of the board negotiated this with the NCAA and the BIG10 without informing any of the other board members. Don't you think it is odd that sanctions of this severity are not discussed with the entire board? Nothing sounds right they wanted to get this done an over with too quickly they are hiding something and that is evident with Corbett pushing Freeh to do the investigation the lack of transparency with the other board members on the sanctions. They are hiding something and did not want a thorough investigation. They are hiding something that I believe is pretty bad that could bring down many people and I would bet my last $ that some of the board members and the Last Mile were in bed together and knew about Sandusky but let it go so it would not screw up business props. They served the football program up too quickly.

    I think in this case, I'd liken it more to a plea bargain for a lesser punishment than a contract signed under duress. With precident already set in court that the NCAA is a private group and can pretty much do as it pleases... suing them wouldn't likely bring anything good. If somehow they tried to sue saying a contract was signed under duress, then the NCAA could just as easily come back and say "Welp...okay, we'll recant that contract and you can face the committee which will give you the same or worse punishment." Even without the possibility of the death penalty, accepting what they've issued now is akin to pulling a bandaid off quickly to get it over with. If they tried to take it to court, it would drag on longer and continue dragging the PSU name through the mud and it would be more pain for the victims as it would undoubtedly stay in the news throughout the duration as a painful reminder.

    While I understand that it's a tough time for any PSU alum, I cant fully comprehend the amount vitriol directed toward Emmert and Erickson for the current situation as opposed to Sandusky, Curley, et al.
