The only way that Paterno gets back into the discussion of being liable for this is if he was in the email distribution list. Even then, he would likely have to reply to prove that he received, and aknowledged the email. Considering that this report specifically targets Spanier and not Paterno, I think there is a good chance that he wasn't included in the emails. Lord knows that the media would be all over it if he was.
