You have to think that their attorney knew this was going to happen, which speeds up a lawsuit.

The only way this carries any weight whatsoever is if the Freeh report can be discredited entirely. Then the NCAA has no case and would have to perform their own investigation, and since they don't have subpoena power...

regardless. There's a lot of chips that would have to fall perfectly for any kind of fight. I'm sure the NCAA's lawyers have been over the sanctions and bylaws, along with the documents PSU signed with a fine tooth comb.

NCAA tossed due process because Penn State allowed them to and agreed to do it. They leaned on the Freeh report because PSU agreed to it and allowed it.

I would love for the sanctions to just disappear, but the only way that happens is if the Freeh Report is 100% discredited and even then, I'm not sure the sanctions would disappear.

I know a lot of people have wished the Paterno's would"just stop talking" but I'm glad they arent listening. I don't think anyone will argue that Joe "could have done more" (in 2001), he admitted that himself. But the whole punishment is based off the fact that this was a "cover-up" which Joe was part of. That to me is proven nowhere, especially not in the Freeh report. I understand Erickson was bullied by the NCAA and shit his pants, as did Peetz and some other Board Members. But I think this is a brilliant move by the Paterno's because they are attacking the NCAA in their name, not in Penn State's name which will nullify any negative public opinion directed toward the University. They are exactly what we need right now, a committed group with financial backing and the best interest of the University as a whole in mind and really nothing to lose.
The Paterno's are smart people, just like Joe, they are patient and calculated and have a lot of resources. I really think they know something or have some foresight into what the Schultz/Curley Trial will bring forward. From Day One, something about this whole situation has been missing, i think that is universally in the back of everyone's mind. There are way too many unanswered questions right now, many people acted in a way that really doesn't match their historical body of work based on what we know now. This could get very interesting.
