  • A random off topic ... I'm getting the shits of 9.5/10 on my papers. These MBA profs have nothing to add to them but yet I can't get that extra .5 ... It's just a dick move when you need a 94 to get a 4.0.

    If winning was easy even losers would do it.

  • So Ryan Braun had the failed drug test overturned.

    When I read the write up on ESPN it really sounds like he got off on a technicality, that really doesn't prove he didn't take a PED or banned substance.

    Pretty sure the sample was deemed tainted because of the way it was handled, but you're right it was more of a technicality. Kind of dumb but that's on the MLB or whoever handled the test. How are you not 100% when you bring up the case against him? Just stupid on their part.

    Yea, we will probably never know for sure.

    People testified that the sample was not tampered with and that normal action was taken when the test are given over the weekend.

    A friend at work told me that Braun challenge that it wasn't his urine and offered a DNA test ... the MLB declined to do that.

    This is why lawyers/arbitration blow. Many of the people who win these things get off on technicalities instead of merit. Pisses me off daily.

    Braun's lawyers found a flaw in the system and convinced 2/3 arbiters that the test cannot be counted because of that flaw. They argued form over substance. They didn't attempt to dispute the results of the test from what I understand, just that there is a problem with the chain of custody (read: the test wasn't handled appropriately by different people with access to it) and the whole thing was flawed. It is a joke and the MLB is furious for good reason. One of their own arbiters was convinced by this BS.

    They should just let the World Anti-Doping Agency handle these cases, although WADA protocol almost impossible to beat and their standard penalty is 2 years with the ability to get down to 1 year if there truly are extenuating circumstances.

    I agree and feel the same way.

    This is why it doesn't make sense to me though, you don't fight the positive test, but because the process isn't strong you get off. The fact remains that you had a positive test.

    Yep. Form over substance. It's, unfortunately, a huge part of the law.

    That's always been one of the most frustrating parts of the judicial system. I know that procedure is pretty much necessary for consistency, but too often they seem to ignore the spirit of the laws to obey the letter.

    So much depends on the jurisdiction and the presiding judge. Some are very heavy one way and some the other. Instead of consistency it's just luck at this point.

    Yeah, I should have said that it's necessary to promote the ideal of consistency. It's not something we've actually attained in any form.

    JMO here, but I think it's much better this way than it was in England.

    It prevents people from taking advantage of the court of public opinion, and shady evidence.

    Plus, if you have a good enough lawyer, this isn't an issue.

    That's an unfortunate problem too. Good lawyers will put you straight into debt. Granted, it's not an issue for Braun or the MLB, but in general, most people must choose the best bargain lawyer.

    Maybe so, but I've never been a fan of comparative arguments. I'm sure our judicial system is better than a lot of countries' systems - that doesn't make it good.

    I'm not sure I'd consider shady evidence that much worse than disallowing evidence based on technicalities.

    I don't think having a "good enough lawyer" necessarily solves many of the problems. Not to mention the fact that good enough lawyers cost pretty pennies.

    Why not? I've known plenty of engineers who have gone on missions trips to other countries and essentially donated their time and services to help people in need.
